1. Definitions

Throughout these Terms and Conditions, the following definitions apply:

• "Agreement" means these Terms and Conditions, together with any engagement letter, service proposal, or written confirmation accepted by both parties.
• "Service" or "Services" means the pension legal advisory services offered by Sukha Counsel, including Document Review and Explanation, Records and Liaison Support, and Review and Appeal Representation.
• "User" or "Client" means any individual who accesses this website or engages the Services of Sukha Counsel, whether for themselves or on behalf of another person.
• "We / Us / Our" refers to Sukha Counsel, its advisers, and authorised representatives.
• "Content" means all materials, written summaries, explanations, correspondence, and documentation produced by Sukha Counsel in connection with the Services.
• "Sensitive Information" means pension documents, personal identification, financial records, and other confidential materials shared by the Client during the engagement.

2. Acceptance of Terms

By engaging Sukha Counsel — whether by submitting an enquiry form, making payment, or proceeding with an agreed service — you confirm that:

• You are aged 18 or older, or are acting on behalf of a retiree or pension holder with appropriate authority to do so.
• You have the legal capacity to enter into a binding agreement under Thai law.
• You have read, understood, and agree to these Terms and Conditions in full.
• If acting on behalf of another person, you have obtained their informed consent and have the authority to bind them to this Agreement.

If you do not agree with any part of these terms, we kindly ask that you contact us before proceeding so that we may address your concerns.

3. Service Description

Sukha Counsel provides pension legal advisory services in Thailand, focused on helping retirees and pension holders understand, navigate, and where appropriate, contest pension-related decisions. Our three service offerings are:

Services are available to clients in Thailand. We reserve the right to decline an engagement where we assess that we are unable to assist effectively or where a conflict of interest exists.

4. User Responsibilities

To allow us to assist you effectively and responsibly, you agree to:

• Provide accurate, complete, and up-to-date information and documents as reasonably requested.
• Inform us promptly of any changes to your circumstances that may affect the engagement.
• Respond to our communications in a reasonably timely manner to avoid delays in your matter.
• Use this website and our services for lawful purposes only.
• Not misrepresent your identity, authority, or the nature of your matter.
• Not reproduce, distribute, or use our written work product for purposes beyond your own personal pension matter without our written consent.

We understand that gathering documents can sometimes be challenging. We are here to help where we can, and we will always approach your matter with patience and care.

5. Intellectual Property

All content on this website — including text, layout, visual design, and documentation — is the intellectual property of Sukha Counsel and is protected under applicable Thai copyright law.

Written summaries, explanations, and documents prepared by us during your engagement are provided for your personal use in connection with your pension matter. You may not reproduce or share this work product commercially or publicly without prior written permission.

You retain ownership of all original documents, records, and personal information you provide to us. We use your materials solely for the purpose of delivering the agreed service.

6. Payment Terms

• Currency: All fees are quoted and payable in Thai Baht (฿).
• Payment timing: Payment details will be provided upon engagement confirmation. We will not begin substantive work until payment or a payment arrangement has been confirmed.
• Accepted methods: Bank transfer and other methods as advised at the time of engagement.
• Refunds: Where work has not yet commenced, we will consider a refund request with care. Once substantive work has begun, fees reflect the time and effort already invested and are generally non-refundable, unless there are exceptional circumstances we agree to consider.
• Third-party costs: Any government fees, official charges, or third-party costs are separate from and in addition to our service fees. We will inform you of any such costs before they are incurred.

You agree to indemnify and hold harmless Sukha Counsel, its advisers, and representatives from any claims, costs, or losses arising directly from your breach of these Terms and Conditions, your misrepresentation of facts relevant to your matter, or your misuse of our services or website. • Entire Agreement: These Terms and Conditions, together with any written engagement confirmation, constitute the entire agreement between you and Sukha Counsel regarding the service engaged.
• Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect.
• Waiver: Our decision not to enforce a particular provision on one occasion shall not constitute a waiver of our right to enforce it on a future occasion.
• Assignment: You may not transfer your rights or obligations under this Agreement to another party without our written consent. We may assign administrative functions in the ordinary course of managing our practice.
